Road Accident Injuries
Have you been injured in a motor vehicle or traffic accident, even as a passenger, cyclist or pedestrian? If so, you may be entitled to compensation.
Road Accident Injuries
Have you been injured in a motor vehicle or traffic accident, even as a passenger, cyclist or pedestrian?
At Kellie Finlay Legal, we can help you get the compensation that you are entitled to. Our expert Lawyers will help guide you through the process.
You can still claim compensation even if you were a passenger in the vehicle that was ‘at fault’ for the accident.
Strict time frames apply to lodge your claim so please contact us for a free case assessment.
Who pays the compensation?
Compensation is paid by the Compulsory Third Party Insurer (CTP). This is covered under the vehicle registration of the vehicle ‘at fault’.
This means the driver ‘at fault’ does not pay an excess or need a Lawyer to represent them as the CTP Insurer will take care of everything.
Public Liability Claims
What is a Public Liability Claim?
Public liability claims are quite broad and apply to any injuries that are not already covered under road or work accident claims.
An example of a public liability accident may be a ‘slip and fall’ or a ‘sporting activity’ accident.
Strict timeframes apply to lodge your claim so please contact us for a free case assessment.
Making a Public Liability Claim
To make a successful Public Liability Claim, you need to be able to prove that:
- you were owed a duty of care
- the duty of care was breached
- it could be predicted that this breach would lead to injury or damage.
Superannuation Claims
Can I make a superannuation claim?
If you have suffered any injury or illness you may be entitled to make a claim under your Superannuation Policy.
Your injury or illness does not have to be caused from work or an accident, and you do not need to prove that anyone was at fault.
Depending on your Policy wording, you may be entitled to claim if you are unable to work in the industry that you are skilled in or, if you are unable to work at all.

Work Compensation Claims
When can you claim workers’ compensation and what am I entitled to?
If you have sustained an injury at work or if your health and well being has been affected in the workplace, you may be eligible to make a claim for workers’ compensation. This includes injuries sustained during lunch breaks, on your way to and from work or generally in the course of your employment even if you aren’t at work.
There is a myth that if you are injured at work as a Contractor that you are not entitled to compensation and that you must have your own Insurance. There are a number of tests that determine what compensation scheme you are entitled to bring your claim under.
Generally, you are entitled to make a claim for statutory benefits which include lost wages, medical and rehabilitation expenses and other costs associated with your injuries.
We work with you to determine your entitlements and assist you in the process. And yes, of course you can still make a claim if you have a pre-existing injury.
Strict time frames apply to lodge your claim so please contact us for a free case assessment.
